Terms and Conditions of Sale
ARTICLE 1 – PURPOSE
These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by SAS VINS & HUILES DE PANERY (or “Seller”), with any non-professional buyer, hereinafter “the Customer,” wishing to purchase products offered for sale by SAS VINS & HUILES DE PANERY on its website www.panery.frThe products presented on this website are offered for sale throughout Metropolitan France and Europe. These conditions apply to the exclusion of all other conditions, particularly those applicable through other distribution and marketing channels. These General Terms and Conditions of Sale are accessible at any time on this website and will prevail, if necessary, over any other version or any other contradictory document. Unless proven otherwise, the data recorded by SAS VINS & HUILES DE PANERY constitutes proof of all transactions. Modifications to these General Terms and Conditions of Sale are enforceable against website users from the time they are posted online and cannot apply to transactions concluded previously. Validation of the order by the Customer constitutes unconditional acceptance of these General Terms and Conditions of Sale.
ARTICLE 2 – PRICE
The prices of our products are indicated in euros including all taxes (VAT and other taxes applicable on the day of the order), unless otherwise stated and excluding processing and shipping costs. These rates are firm and non-revisable during their period of validity, as indicated on the SAS VINS & HUILES DE PANERY website. They do not include transport and delivery costs, which are invoiced in addition. In all cases, an invoice or note is issued by SAS VINS & HUILES DE PANERY and given to the customer upon delivery of the ordered products. All orders, regardless of their origin, are payable in euros. SAS VINS & HUILES DE PANERY reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time of order validation and subject to availability. The products remain the property of SAS VINS & HUILES DE PANERY until full payment of the price. Note: As soon as you take physical possession of the ordered products, the risks of loss or damage to the products are transferred to you.
ARTICLE 3 – ORDERS

SAS VINS & HUILES DE PANERY reserves the right not to register a payment and not to confirm an order for any reason whatsoever, particularly in case of supply problems or difficulties concerning the received order. Only legally responsible persons capable of entering into contracts concerning the products offered by SAS VINS & HUILES DE PANERY can order on the website. In particular, and in application of Article L.3342-1 of the Public Health Code, any customer must have reached the full age of 18 years.
To place an order on the website www.panery.fr, the customer must first register and provide SAS VINS & HUILES DE PANERY with the essential information (Name, first name, personal address and delivery address, phone number…) for the attribution of an account name and password allowing their identification. It is the Customer’s responsibility to select the products they wish to order on the site, validate their order, and then proceed with payment by credit card according to a secure procedure. Product offers are subject to stock availability. Indications on product availability are provided at the time of order placement.
ARTICLE 4 – VALIDATION OF YOUR ORDER
Any order appearing on the site www.panery.fr implies adherence to these General Terms and Conditions. Any order confirmation entails your full and complete adherence to these general terms and conditions of sale, without exception or reservation. All data provided and the recorded confirmation will constitute proof of the transaction. You declare to have perfect knowledge of it. The order confirmation will serve as signature and acceptance of the operations carried out. Orders are firm, final, and not subject to modification or cancellation, except under conditions set by Article 6 of these conditions.
ARTICLE 5 – PAYMENT
Validating your order implies your obligation to pay the indicated price. Payment for your purchases is made by credit card. The card is debited at the time of the order.
ARTICLE 6 – WITHDRAWAL
The customer has a right of withdrawal which can be exercised within seven (7) calendar days following the date of receipt or collection of the order. If this period expires on a Saturday, Sunday, or public holiday, it is extended until the next working day. The customer who wishes to exercise their right of withdrawal must return the goods or products within the aforementioned period, in their original packaging, complete, new, and in perfect condition. Return costs are the exclusive responsibility of the customer. The return of products must be accompanied by the invoice issued at the time of delivery. Exchange (subject to availability) or refund will be made within a maximum of thirty (30) days from the date of the original delivery of the products to the customer.
ARTICLE 7 – AVAILABILITY
Our products are offered as long as they are visible on the website www.panery.fr and within the limit of available stock. In case of product unavailability after placing an order, we will inform you by email. The order will be automatically canceled and no bank charge will be made.
ARTICLE 8 – DELIVERY
Deliveries are made by an independent carrier without quantity limit, either by carrier or postal package for 3 or 6 bottles ordered. SAS VINS & HUILES DE PANERY commits to do what is necessary to deliver or have the products ordered by the customer delivered within fifteen (15) days from the effective payment of the order. Products are delivered to the delivery address indicated during the order process. In case of shipping delay, an email will be sent to inform of any consequence on the delivery time that was specified. In accordance with Article L.114-1 of the Consumer Code, the customer can cancel any order over 500 euros by registered letter with acknowledgment of receipt in case of exceeding the delivery date by more than seven (7) days and not due to a case of force majeure. This sales contract is considered terminated upon receipt by SAS VINS & HUILES DE PANERY of the registered letter by which the customer informs of their decision unless delivery has not occurred between the sending and receipt of this letter. In this case, the customer then exercises this right within sixty (60) working days from the date indicated for delivery. The customer is required to verify the condition of the products delivered at the time of delivery. They have a period of three (3) days from delivery to make any reservations or complaints for non-conformity or apparent defect of the delivered products by email or postal mail, with all supporting documents. After this period and in the absence of having respected these formalities, the products will be deemed compliant and free from any apparent defect and no complaint can be validly accepted by SAS VINS & HUILES DE PANERY. SAS VINS & HUILES DE PANERY will replace as soon as possible and at its expense, the delivered products whose apparent defects or non-conformities have been duly proven by the customer. SAS VINS & HUILES DE PANERY cannot be held responsible for delivery delay due exclusively to the unavailability of the customer following several appointment proposals.
ARTICLE 9 – WARRANTY
All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 1641 and following of the Civil Code. All claims, requests for exchange or refund must be made by registered mail within thirty (30) days after receipt. The provisions of this article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
ARTICLE 10 – RESPONSIBILITY
The products offered comply with current French legislation. The responsibility of SAS VINS & HUILES DE PANERY cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order. Moreover, SAS VINS & HUILES DE PANERY cannot be held responsible for damages resulting from misuse of the purchased product. Finally, the responsibility of SAS VINS & HUILES DE PANERY cannot be engaged for any inconvenience or damage inherent to the use of the Internet network, including a service interruption, external intrusion or the presence of computer viruses.
ARTICLE 11 – APPLICABLE LAW IN CASE OF DISPUTES
The language of this contract is French. These terms of sale are subject to French law. In case of dispute, French courts will have exclusive jurisdiction.
ARTICLE 12 – INTELLECTUAL PROPERTY
All elements of the site www.panery.fr are and remain the intellectual and exclusive property of SAS VINS & HUILES DE PANERY. No one is authorized to reproduce, exploit, redistribute, or use in any capacity, even partially, elements of the site whether they are software, visual or sound. Any simple or hypertext link is strictly prohibited without express written agreement from SAS VINS & HUILES DE PANERY.
ARTICLE 13 – PERSONAL DATA
SAS VINS & HUILES DE PANERY reserves the right to collect nominative information and personal data concerning you. They are necessary for the management of your order as well as for the improvement of services and information we send you. They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment. This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations. In accordance with the law of January 6, 1978, you have a right of access, rectification and opposition to nominative information and personal data concerning you, directly on the website.
ARTICLE 14 – ARCHIVING PROOF
SAS VINS & HUILES DE PANERY will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
ARTICLE 15 – ALCOHOL CONSUMPTION
